President Basescu: Abuse of power
The President of Romania Traian Basescu accused the Tariceanu government of abusing power by issuing emergency ordinance to modify the ministerial responsibility law. He claimed the entire government was now "in conflict with Justice". As far as justice minister Tudor Chiuariu is concerned, the President accused him straight, mentioning the ordinance was in his favor.
According to Transparency International-Romania, the existence of the special commission in Cotroceni Palace is ungrounded. The Juridical Resource Center argues that, theoretically, it is normal that commission members should be appointed by the Superior Council of Magistracy. As for politicians, they have different opinions.
According to the President, the above-mentioned ordinance has go elements pointing to an abuse of power, as the Justice minister promoted it to pursue his personal interest. The President announced he wouldn't put up with an interruption of the fight against corruption and with Romania's return to the past due to the political control on Justice. He insisted: "I will not agree that something as important as Romania's credibility in the EU should be doubted because of the Romanian government's preferential attitude" He said he had never seen a government "to defy public opinion so serenely and work so intensely against public institutions and the idea of justice". Maybe only those ruling before the 1989 Revolution used to do it, he added.
"When will they modify the Constitutions by ordinances?"
The government's decision is but an attempt to deadlock some high corruption cases for a long time and the normal work of Justice in Romania, the President argued. He explained that they had taken advantage of the "noise" on the bill against the government to pass a document and deadlock the special commission's activity, focused on criminal cases against present minister, Tudor Chiuariu and labor minister Paul Pacuraru among them. He mentioned: "They changed the commission structure while the analysis of criminal cases against present and former ministers was progressing and they thus deadlocked inquiries against those suspected of committing crimes during mandate."
The President argued as follows: "I wonder if, when releasing this ordinance, the government members imagined they also suspended that Constitution article according to which the President must analyze and consent or not to inquiry and trial against a present or former minister. They have practically got the impression that they suspended the President's Constitutional attribution by an emergency ordinance. When will they modify the Constitution by simple ordinances?"(...)
He also outlined the move was made just before the commission's consent to the opening of criminal inquiry against minister Chiuariu and minister Pacuraru. The hasty ordinance, he argued, confirmed the government's target to deadlock consents. The President concluded the government was making use of the right to release emergency ordinances to provide full immunity to all government members. He also wondered if such haste, visible in the very first day after the bill against the government had failed, had something to do with the bargain between some ex officials and the Tariceanu Cabinet.
